It will be interesting to watch the progress of the proposed “Liability for NHS Charges (Treatment of Industrial Disease) (Scotland) Bill”, currently progressing through Scottish Parliament.
This will potentially amend the existing Health and Social Care (Community Health and Standards) Act 2003, to enable resultant NHS costs treatment of people with industrial diseases, to be recovered from negligent employers.
Currently only compensated physical type injury claims, includes the liability to pay the associated NHS charges for treatment.
