A new ACAS guide, produced in partnership with the Equality and Human Rights Commission, entitled Managing Redundancy For Pregnant Employees Or Those On Maternity Leave has been published.
In our experience employers are often reluctant to make pregnant employees or those on maternity leave redundant. Indeed, some are even under the misconception that you cannot make a pregnant employee or an employee on maternity leave redundant. This guide seeks to dispel this myth and others in this area that have built up over the years. However, while it gives a useful background this is a difficult area of employment law and we would suggest that you contact your Legal Manager if you find yourselves having to start a redundancy process involving a pregnant employee or an employee on maternity leave.
