FOCUS ON HANDLING GRIEVANCES; AVOIDING CONSTRUCTIVE DISMISSAL
Sometimes the first warning you get of a problem at work is an employment tribunal application form, telling you a member of your staff has left and is complaining of constructive dismissal. Whether the allegations concern bullying, overwork, a change to working conditions, or management (mis)behaviour, the issue could nearly always have been nipped in the bud at an early stage if the employee had raised a grievance.
We often think of grievances and the people who raise them as a nuisance. They certainly take up management time. But the whole point of grievance procedures is to deal with problems at an early stage. Sometimes grievance have no basis to them whatsoever. Sometimes they reveal that something has gone badly wrong, and give management an opportunity to put matters right, quickly and firmly.
This two and a half hour session will deal with spotting potential grievances at an early stage, investigating them fully, dealing with them fairly, and how they interact with disciplinary procedures. It will also look at recent trends in constructive dismissal, and, drawing on the case law, will set out how to prevent a grievance turning into a tribunal claim, and what you have to prove if you end up facing a constructive dismissal claim.
The session will be ideal for general and line managers looking to add to and refresh their knowledge. It will also benefit HR managers seeking to develop the skills and knowledge in this area. The details are as follows:

90 MINUTE BRIEFING ON THE EQUALITY ACT 2010
The Equality Act was slipped onto the Statute Book shortly before the general election. It wasnt clear for several weeks following the election whether the coalition government would implement its provisions, and some of those scheduled for next year remain in doubt.
The main provisions dealing with individual rights, however, are expected to come into effect in early October. The Act brings together all the laws which currently deal with all aspects of discrimination, including gender, race, disability, age, sexual orientation, religion and belief, marriage, pregnancy and maternity, and gender reassignment.
But as well as bringing existing law together, a variety of new rights are being introduced, extending protection from harassment, making discrimination by association unlawful, and changing the law relating to victimisation, among others.
